Please read these Terms & Conditions (“Terms”) carefully before enrolling in any online course (“Online Courses) offered by Fresh Tracks Chalet Hosting and Cookery School (“we”, “us”, “our”, or the “Company”). By purchasing or enrolling in an online course, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website, purchase or enroll on our Online Courses. These Terms apply in addition to our Privacy Policy and any other policies displayed on our website.

1. Course Access & Delivery
The Online Course will be delivered via the Thinkific platform. Access will be granted via a login provided to you after registration and payment.
You are responsible for arranging and maintaining your own internet connection, computer or device, and any software required to access the course materials.
We grant you a non‑exclusive, non‑transferable licence to access and use the Online Course materials for your personal, non‑commercial use only, subject to your compliance with these Terms.
2. Payment, Refunds & Cancellation
Payment for the Online Course must be made in full at the time of enrolment. Once you have been granted access to the Online Course content, refunds are limited to the extent permitted by law and our specific refund policy.
We reserve the right to cancel or postpone an Online Course. In such case we will notify you and offer a full refund or transfer to an alternative course.
For multi-course bundles, access to each included course will be granted according to the published schedule. Bundled courses are sold as a single package and are non-transferable. Partial refunds for incomplete or unused courses in a bundle will not be issued unless required by law.
3. Student Conduct & Responsibilities
Cooking and food‑preparation activities inevitably involve the use of knives, hot pans, ovens, and other potentially hazardous equipment. You acknowledge and accept this risk and agree to engage with the Online Course in a responsible manner, follow all instructions and guidance provided, and act in a way that does not disrupt the course or infringe other participants’ rights.
If you are under 18 years of age, you must have the consent of your parent or guardian, and a responsible adult must supervise any cooking or practical tasks at home.
You are responsible for creating a safe environment in your home (or wherever you are participating) while carrying out cooking or practical tasks and must comply with all health & safety, food hygiene, and kitchen safety guidance provided by the Company (see our Health and Safety Policy). The Company shall not be liable for any injury, death, and/or damage caused by your use of the website, the Online Course content, or participation in practical cooking tasks at home, save for death or personal injury resulting from our negligence.
Students with impaired sight or mobility should self‑assess (and for under‑18s, parents/guardians should assess) whether the practical tasks are suitable, especially tasks requiring sharp knives, hot hobs (gas or electric) or ovens.
4. Intellectual Property
All course materials (videos, text, images, graphics, software, etc.) are owned by or licensed to the Company and protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, transmit, publicly display, or create derivative works from the course materials without our express written permission.
You agree to respect our and others’ intellectual property rights and not to upload, transmit, or share material that infringes such rights.
5. Limited Warranties & Liability
The Online Course is provided “as is” and we make no warranties, whether express or implied, about the results of your participation or your ability to complete the course or achieve any particular outcome.
To the maximum extent permitted by law, the Company and its directors, employees, or agents shall not be liable to you for any direct, indirect, incidental, consequential, or special damages arising from your access to or use of the Online Course or its materials.
Nothing in these Terms shall limit or exclude liability for death or personal injury resulting from our negligence or for any other liability which cannot be excluded or limited under applicable law.
6. Indemnity
You agree to indemnify, defend, and hold harmless the Company, its officers, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising from your breach of these Terms, your use of the Online Course, your cooking or practical activities at home, or your violation of any rights of a third party.
7. Data Protection & Communications
By enrolling you consent to our use of your personal data as set out in our Privacy Policy.
We may send you course updates, administrative notices, marketing communications, and other messages by email. You can opt‑out of marketing communications at any time per our Privacy Policy.
8. Termination & Suspension
We may suspend or terminate your access to the Online Course if you breach these Terms, behave inappropriately, violate intellectual property rights, or for any other reason in our reasonable sole discretion. On termination, you must cease using the course materials and destroy any copies you have made.
9. Changes to Terms
We reserve the right to modify, amend, or update these Terms at any time. If we do so, we will notify you (e.g., via email or website notice). Your continued use of the Online Course after changes are published constitutes your acceptance of the updated Terms.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England & Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
